1. Introduction & Acceptance
Welcome to fbacenter ("we," "our," "us"). These Terms and Conditions ("Terms") govern your use of our website (fbacenter.com.au) and the provision of our services.
By accessing our website or engaging our services, you ("you," "the client") agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must cease using our website and services immediately.

We provide a range of e-commerce, logistics, and business services ("Services"), including but not limited to:

Product Sourcing & Buying

Junk Removal & Moving
Used Phone Purchasing

3. Quotes, Orders & Payment
Quotes: All quotes provided by us are based on the information you provide and are valid for a period of 30 days unless otherwise stated. Quotes are an estimate and may be subject to change.
Orders: To engage a service, you must follow the instructions provided on our website or in direct communication with us.
Payment: You agree to pay all fees and charges for the services as specified in our quote or invoice. All prices are in Australian Dollars (AUD) and are exclusive of GST unless otherwise stated. Invoices are payable within the terms specified on the invoice (e.g., 7 days). We reserve the right to suspend services for overdue accounts.
4. Client Responsibilities
You agree to:
Provide accurate, complete, and current information when requested.
Comply with all applicable laws and regulations in Australia.
Ensure that any goods you ask us to store, handle, or transport are not illegal, dangerous, or hazardous. You retain ownership and responsibility for your goods at all times.
5. Limitation of Liability
To the fullest extent permitted by Australian Consumer Law, our liability for any loss, damage, or claim arising out of the provision of our Services is limited to the cost of the service provided. We are not liable for any indirect, consequential, or economic loss, or for any loss of profit.
6. Indemnity
You agree to indemnify and hold harmless fbacenter, its employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of our Services or your breach of these Terms.
7. Service-Specific Terms
a) Fulfilment, Warehousing & FBA Prep:
We will take reasonable care in handling and storing your goods. However, we are not liable for damage or loss unless caused by our gross negligence. We recommend you maintain your own insurance for your inventory.
You are responsible for ensuring your products comply with all requirements of any third-party marketplace (e.g., Amazon FBA).
b) Junk Removal & Moving:
You must ensure you have legal authority to dispose of or move the items in question.
You must ensure our team has safe and clear access to the property. We are not liable for damage to property unless caused by our direct negligence.
c) Sell Your Phone Service:
The initial quote is based on your description. If our physical inspection reveals a different condition, we will provide a revised quote. You may accept the revised quote or have the device returned to you.
You confirm that you are the legal owner of the device.
By sending us your device, you consent to our secure data wipe process. This process is irreversible. Once you accept our final offer and payment is made, the sale is final.
d) Virtual Business Address:
The service is for mail handling only. It must not be used as a registered business address for ASIC purposes unless specified.
We reserve the right to inspect mail for prohibited items. We will not forward illegal, dangerous, or suspicious items.
You must provide valid identification for verification purposes.
8. Termination
Either party may terminate the service agreement with 30 days' written notice. We may terminate services immediately if you breach these Terms.
9. Dispute Resolution
If a dispute arises, both parties agree to first attempt to resolve it in good faith through direct negotiation. If the dispute cannot be resolved, we agree to pursue mediation before commencing legal proceedings.
10. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
11. Changes to These Terms
We may update these Terms from time to time. The latest version will always be posted on our website. Your continued use of our services after any changes constitutes your acceptance of the new Terms.
